Public Comments
I reserve the right to moderate any comments made on this website, in the Facebook Groups I control, and on any of my social media pages and profiles, including deleting comments that I deem to be rude, offensive, spammy or unacceptable, without any notification or correspondence with you. Keep all communication kind and polite, please.
Disrespectful or aggressive behaviour towards me, my team, my guest bloggers, or anybody else will not be tolerated.
If a dispute arises, or if you feel that any of the content on my website infringes on your rights in any way, you agree to refrain from engaging in any public discussions regarding the matter, communicate with me in a polite and respectful manner and avoid any behaviour or communication that could reasonably be expected to negatively impact my business or personal interests or those of my guest bloggers. The foregoing applies even if Beyond Betrayal has been advised of the possibility or could have foreseen the damages. In those States and Territories that do not allow the exclusion or limitation of liability for the damages, our liability is limited to the fullest possible extent permitted by law. In no event shall Beyond Betrayal’s cumulative liability to you exceed $100.

Jurisdiction & Dispute Resolution
Jurisdiction
Madonna Keightley, the business owner of Beyond Betrayal is located in Victoria (VIC) Australia. This agreement is subject to the governing law of Victoria.
Negotiation
If you have a complaint arising out of your use of this website, or these terms and conditions, you and Madonna Keightley agree to make a genuine effort to resolve the dispute through negotiation and discussion.
Mediation
If we are unable to resolve a dispute by negotiation and discussion within 14 days, the parties must proceed to mediation with the assistance of an accredited mediator, who is independent of the parties. The mediator is to be appointed by the agreement of the parties or, failing agreement within twenty-one (21) days of the first notification of the dispute, by a person appointed by the Chair of Resolution Institute, (ACN 008 651 232, Level 2, 13-15 Bridge Street, Sydney NSW 2000; telephone: 02 9251 3366, email: infoaus@resolution.institute or the Chair’s designated representative. The Resolution Institute Mediation Rules shall apply to the mediation. We agree to share the costs of the mediation equally between us.
Litigation
It is a condition precedent to the right of either party to commence litigation that we have tried dispute resolution. Litigation is to be considered a last resort and may not be commence until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted. In other words, this means that we agree not to go to court until we really tried our best to work things out, and the mediator agrees that we cannot resolve this on our own, so we will need a judge to make the decision for us.
Entire Agreement, Waiver, Headings
These Terms constitute the entire agreement between you and Behyond Betrayal pertaining to the Site and Service and supersedes all prior and contemporaneous agreements, representations, and understandings between us. No waiver of any of the provisions of this Agreement by Beyond Betrayal shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by Beyond Betrayal. The subject headings of these Terms are included for convenience only and shall not affect the construction or interpretation of any of its provisions.
